Fair Use & Terms of Service

Eligibility: You must be at least 18 years of age and acting on behalf of a registered business to use this service. By creating an account you confirm you meet these requirements.

We believe in keeping legal agreements as simple and transparent as our technology. By connecting your store to AgenticMCPStores, you agree to these fair use principles designed to support a healthy ecosystem for merchants and AI agents.

1. Your Store, Your Rules

You maintain full intellectual property rights over your catalog, imagery, and branding. AgenticMCPStores simply acts as passing infrastructure (the bridge) enabling AI agents to read your public data and suggest items to users.

2. Acceptable Agentic Use

You agree not to use our gateway to proxy malicious payloads, manipulate transactions, or sell illegal goods. We reserve the right to sever connections to stores that violate global e-commerce compliance standards.

3. Service Availability and Rate Limits

As AI traffic scales unpredictably, free tier accounts are subject to fair-use rate limits to prevent network degradation. Pro and Enterprise accounts receive dedicated throughput capacity.

4. Liability Limitation

While we ensure the secure transmission of checkout payloads, the final merchant-of-record responsibility remains with you (via your Shopify or WooCommerce backend). AgenticMCPStores is not liable for fulfillment failures or chargebacks.

5. Cap of Liability (Risk Limitation)

As a B2B SaaS, our maximum aggregate liability is strictly limited to the fees paid by you in the 12 months prior to the incident. If you use a free tier, liability is capped at €100. We are not liable for indirect damages or lost profits.

6. AI Agent Financial Independence

We provide the MCP protocol but do not control the underlying LLM. If you choose to disable Human-in-the-Loop confirmations, you expressly assume 100% of the financial risk against hallucinations or erroneous AI actions.

7. AI Agent Transactions

AI Agent Transactions: Transactions processed through the AgenticMCPStores Agent API may be initiated by artificial intelligence agents acting on behalf of human users. These transactions are identified with the `X-Initiated-By: ai-agent` response header in compliance with EU AI Act Article 50 (Regulation 2024/1689). Merchants receiving orders via MCP integrations acknowledge that buyers may include automated AI agents. This does not affect the legal validity of transactions.

8. Indenpendence & Force Majeure

We are not responsible for downtimes caused by force majeure events, including external cloud failures (e.g. AWS/Vercel), upstream LLM outages, or unavailability of third-party merchant platform APIs (e.g. Shopify, WooCommerce, PrestaShop). Regarding dispute resolution: in jurisdictions where legally enforceable (e.g. United States), you agree to resolve disputes individually and waive class action rights. In Spain and the European Union, local procedural law applies and this waiver is limited to the extent permitted by mandatory applicable law.

9. Data Processing Agreement (DPA)

When you process personal data of end buyers through AgenticMCPStores (e.g. shipping addresses, order details), we act as your data processor under GDPR Art. 28. By accepting these Terms at registration, you also accept our Data Processing Agreement. The DPA governs: data minimization, security measures, subprocessor list, breach notification, and international transfer safeguards (SCCs/DPF). 10. Cancellation & Refund Policy

You may cancel your subscription at any time from your merchant dashboard. Cancellation takes effect at the end of the current billing period — you retain full access until then. For annual plans, refunds are issued on a pro-rata basis for unused full months, provided the cancellation request is made within 30 days of the renewal date. Monthly plans are non-refundable once a billing cycle has started. To request a refund, contact support@agenticmcpstores.com within the applicable window.

11. Merchant Obligations When Activating Third-Party Payment Protocols

When you activate payment processing protocols (such as Stripe, PayPal, or other payment processors) through AgenticMCPStores, you agree to the following obligations: (a) You must maintain a Privacy Policy that discloses Stripe and PayPal as payment processors, and notes that PayPal acts as an independent data controller; (b) You must maintain a clear Refund Policy specifying return conditions, refund timeframes, and procedures; (c) You must provide customer support contact information (email or contact form) accessible from your store; (d) For Stripe Connect: You acknowledge that funds flow directly from your customer to your Stripe Connected Account, and AgenticMCPStores does not intermediary these payments; (e) You remain liable for customer disputes and chargebacks as the merchant of record. Failure to maintain these obligations may result in suspension of payment processing capabilities.
